1. Who We Are

Creatineers Studio is operated by TDU Learning LLC (“Creatineers”, “we”, “us”). We provide an AI literacy platform for K–12 students through authorized school accounts.

2. What Information We Collect

Students: We collect only a pseudonymous username chosen or assigned by the school. We do not collect real names, email addresses, dates of birth, phone numbers, or any other personally identifiable information from students.

Teachers and school administrators: We collect name, school email address, and school affiliation for account management purposes.

Usage data: We store the AI prompts and creative outputs submitted through the platform, associated with the student's username only.

Technical data: Our servers log IP addresses for security purposes. Logs are retained for 30 days and then deleted.

3. How We Use Information

We use collected information solely to provide the Creatineers Studio educational service. Specifically:

We do not use student data for advertising, marketing, commercial profiling, or AI model training.

4. COPPA Compliance

Creatineers Studio is designed for use in schools with students who may be under 13 years of age. We do not knowingly collect personal information from students — only pseudonymous usernames. The school (Educational Agency) acts as the operator's agent for COPPA purposes, and student accounts are created and managed by the school, not by students directly.

Parents may contact info@academyofanimatedart.com to request review or deletion of any data associated with their child.

5. FERPA Compliance

Creatineers acts as a “school official” under FERPA, using student data only to perform contracted educational services on behalf of the school. We do not disclose student education records to third parties without authorization. Parents and eligible students (age 18+) may request access to their data by contacting the school.

6. New York Education Law 2-d

Creatineers complies with New York Education Law Section 2-d and its implementing regulations. Student personally identifiable information will not be sold or used for any commercial or marketing purpose. We maintain a Data Privacy and Security Plan aligned with the NIST Cybersecurity Framework v1.1.

7. Data Sharing

We do not sell student data to any third party.

We use fal.ai to process AI image generation requests. fal.ai does not use submitted data to train AI models. [CONFIRM: verify fal.ai DPA and insert reference.] No student-identifying information is included in requests to fal.ai.

We do not share data with advertisers or marketing platforms.

8. Data Security

All data is encrypted in transit using TLS 1.2 or higher and encrypted at rest using AES-256 (Supabase / AWS). Access to student data is restricted to authorized Creatineers personnel and the school's designated administrators.

In the event of a data breach, we will notify the affected school(s) within 7 business days of discovery.

9. Data Retention

Student session and activity data (AI prompts, generated outputs) is retained for the duration of the school year and securely deleted at the end of each school year on June 30 annually.

Upon contract termination, all school data is returned or securely destroyed within 30 calendar days of the contract end date.

10. Your Rights

Parents and eligible students (age 18+) may request to inspect, review, or correct their data. Contact your school administrator to exercise these rights, or contact us directly at info@academyofanimatedart.com.

Complaints about data privacy practices may also be submitted to the New York State Education Department at privacy@nysed.gov.

11. Changes to This Policy

We will notify affected schools at least 30 days before making any material changes to this Privacy Policy.
